Aluminium Road Wheels exported to Australia from The People’s Republic of China

​Speedy Corporation Pty Limited, AM Taleb Holdings Pty Ltd t/as Taleb Tyres & Wheels, GM Holden Limited, Samad Tyres Pty Ltd t/as Motorsport Wheels & Tyres, Ford Motor Company Australia Ltd, YHI Manufacturing (Shanghai) Co. Ltd and YHI (Australia) Pty Ltd, StarCorp Holdings (NSW) Pty Ltd, CITIC Dicastal Wheel Manufacturing Co. Ltd and Jiangsu Shenzhou Wheel Manufacturing Co. Ltd t/as Runder Autopart Co. Ltd have applied to the Trade Measures Review Officer (TMRO) requesting a review of the decisions made by the Minister for Home Affairs (the Minister) on 5 July 2012 to publish dumping duty notices and countervailing duty notices for Australian Road Wheels exported to Australia from The People’s Republic of China. The review, under section 269ZZK of the Customs Act 1901, by the TMRO involves a decision to either affirm the reviewable decisions or recommend that the Minister direct the CEO to reinvestigate a finding or findings that formed the basis of the reviewable decisions, based on the information that was before the CEO when the Minister made the reviewable decision. 

Extension of Time

The Minister for Home Affairs has approved an extension of time of approximately 5 weeks for the TMRO to make a decision on the applications for review of the Minister’s decisions to publish a dumping duty notice and a countervailing duty notice in respect of Aluminium Road Wheels exported to Australia from China, pursuant to s 269ZZK(3)(b) of the Customs Act 1901 (Cth). I am now required to make a decision in this matter by 21 December 2012.

Summary of Finding

The decision has been made to direct the CEO of the Australian Customs and Border Protection Service to reinvestigate some of the findings made in REP181; being those findings identified in the TMRO's report at paragraphs 17 and 18. Notice of this decision was published in the Australian on 23 January 2013.

Please be advised that the notice contains an incorrect reference to "Hollow Structural Sections" in the third to fourth line of text. The notice should refer to "Aluminium Road Wheels".
